When Do I Need to File a Mexico Declaration of Use for Trademark Maintenance?

In Mexico, if your trademark was granted on or after August 10, 2018, you must file a Declaration of Use within three months following the third anniversary of the date your registration was granted by IMPI.

Additionally, a declaration (or equivalent confirmation) is also required at the time of renewal, every 10 years. Missing the filing deadline can result in automatic cancellation of your trademark registration.

What Happens if I Miss the Deadline to File the Declaration of Use in Mexico?

Do I Need to Submit Proof of Use with the Declaration in Mexico?

For the standard Declaration of Use filing in Mexico, IMPI does not require supporting evidence to be uploaded with the form itself. However, it’s still important to keep internal proof of use records in case of future disputes (such as invoices, product packaging or labels, marketing materials, screenshots of your website, or proof of sales/availability in Mexico).

Don’t worry, your dedicated agent will confirm what documentation you should have ready for your specific case.

Does This Apply to International Registrations Designating Mexico (Madrid System)?

Yes. If your trademark is protected in Mexico through an international registration, you may still need to file the declaration directly with IMPI. We’ll confirm what applies to your case.

Can You Help if I’m Filing as Part of a Renewal?

Yes. We can assist with Declaration of Use filings that are required as part of ongoing trademark maintenance, including renewal-related requirements.
