Jordan is a “first to file” jurisdiction, so registration is mandatory in order to be granted rights over a trademark. Only in some exceptional cases can an unregistered mark be protected, which makes filing a national registration the practical way to secure exclusive rights and prevent others from protecting a similar sign in your place.
Trademark applications must be filed with the Trademark registration section of the Ministry of Industry, Trade and Supply of the Hashemite Kingdom of Jordan MIT.
It is not necessary for the trademark to be in use in Jordan to be filed or registered. However, prior use may be useful to overcome objections on the grounds of lack of distinctiveness, by showing that the mark has acquired distinctiveness through use.
If you register a combined trademark (with both word and figurative elements) in Jordan, your exclusive rights are limited to using the mark in the exact configuration in which it was filed and registered. If you want to use the word part separately from the logo (or vice versa), it is advisable to file an additional application for the specific elements you wish to protect on their own.
For trademark search reports, the mark must be in the Latin alphabet, and the search will only consider other marks also in Latin script. If you need a search for a mark in Arabic, including results for trademarks in the local alphabet, you must request a specific search service, for which additional fees will apply.
