Industrial Design Registration in China

An industrial design refers to the visual or aesthetic aspect of a product. In China, industrial design registration covers the shape, pattern, color, or a combination of these, as long as they are new and can be applied to an industrial product. This registration does not protect technical or functional features of the product but focuses on aspects that appeal to the eyes, making it unique in the market. Examples of industrial designs that can be protected include:

• Packaging designs
• Product shapes
• Patterns and ornamentation
• User interface designs (for certain products)

The design must be original, meaning it has not been made public anywhere before the filing date.

From the moment an industrial design application is filed with the China National Intellectual Property Administration (CNIPA), the registration process typically takes around 6 to 9 months. This includes the time for the formal examination, where the CNIPA checks that all required documents are in order. Once the application passes this stage, the design is published in the official gazette, and the registration certificate is issued.

To register an industrial design in China, the following documents are required:

1. Power of Attorney (POA): A Power of Attorney document that is simply signed by the applicant. No notarization or legalization is required. This document can be scanned and submitted electronically.
2. Drawings: Clear and accurate drawings of the design that show all its visual aspects.
3. For companies: A scanned copy of the certificate of incorporation.
4. For individuals (natural persons): A scanned copy of the applicant’s passport.

These documents are necessary to ensure that the application is complete and meets the formal requirements set by the CNIPA.

Once an industrial design is registered in China, it is valid for 10 years from the filing date. However, to maintain this protection, the industrial design must be renewed every year through the payment of an annual annuity. Failure to pay the annuity on time will result in the industrial design lapsing, and it will enter the public domain, making it available for use by anyone without your consent.
