Vietnam Trademark Renewal

A trademark is valid for 10 years from the filing date and can be renewed indefinitely for successive 10-year periods.

• Renewal window: 6 months before the expiration date
• Grace period: 6 months after expiration
• After grace period: The trademark automatically lapses and cannot be restored

• Signed Power of Attorney (with company seal if available); no notarization or legalization required
• Original Trademark Registration Certificate (optional but recommended if updates are to be recorded on it)
• No proof of use required
• Renewals are published in the Official Gazette of Industrial Property

• Restoration is not possible
• A lapsed mark is blocked from re-registration by third parties for 3 years, unless the original owner failed to use it for 5 consecutive years before expiry

• IP Vietnam does not notify owners or agents of pending cancellations
• Monitoring is the owner's responsibility

You can still renew your mark during the 6-month grace period by paying a monthly late fee. After this, your trademark automatically lapses and must be refiled.
