Iraq Trademark Renewal

A trademark in Iraq is valid for 10 years from the filing date and can be renewed for further 10-year periods. Older trademarks registered before April 26, 2004, had an initial 15-year validity, which now renew under the 10-year rule.

• 1 year before expiration: You may renew the trademark.
• 6-month grace period after expiration: You may renew late by paying a fine.
• After the grace period: The trademark automatically lapses and cannot be restored.

• Power of Attorney, signed, stamped, and legalised at the Iraqi Consulate abroad
• Additional local legalisation in Iraq: Central Bank, General Tax Commission, and Ministry of Foreign Affairs
• Copy of the registration certificate or last renewal certificate
• Payment of renewal and late fees, if applicable

Renewals are published in the Official Gazette.

• Baghdad: Renewal during grace period costs IQD 575,000 for the first subclass, plus additional fees for more subclasses
• Erbil (Kurdistan): Grace period renewal is USD 961 for the first subclass, with added charges per additional subclass.

• Restoration is not allowed. Once lapsed, a new application must be filed.
• A lapsed mark may not be registered by another party until at least 1 year after cancellation, or earlier if approved by the Registrar.

• Keep your Power of Attorney updated and properly legalised
• Track your deadlines: no reminders are sent
• Update any change in ownership or representation
