Why and How to Register a Trademark in Namibia
In order to obtain trademark protection in Namibia, one may either file an application through the Department of Trademark and Commerce of the Ministry of Trade and Industry of Namibia, or register the trademark regionally through the African Regional Industrial Property Organization (ARIPO).
Namibia is a member of the African Regional Industrial Property Organization (ARIPO) and a party to the Banjul Protocol. Registration through ARIPO grants protection and recognition in the following 12 countries: Botswana, the Gambia, Lesotho, Liberia, Malawi, Mozambique, Namibia, Sao Tome and Principe, Eswatini, Uganda, Tanzania (mainland) and Zimbabwe. If you register a combined trademark (which includes both word elements and figurative elements) in Namibia, the exclusive right to use the trademark is limited to a use of the trademark in the exact configuration or way in which it was filed and registered. If you wish to use the word element of your trademark separately from the logo (or vice versa), it is recommended you register for another trademark including only the word or figurative elements you wish to use and protect separately.
Nevertheless, if a third party eventually intends to register or use a trademark for similar goods or services that includes a primary or distinct part or portion of your trademark, you will have the right to oppose the application based on confusing similarity. The probabilities of success for an opposition will vary in each case depending on the circumstances.
A registered trademark in Namibia will be valid for ten (10) years. Trademarks may be renewed for an additional ten (10) years. There are no limits to how many subsequent renewals of a registered trademarks may be done.
