Netherlands Trademark Renewal

Trademarks registered in the Benelux region are valid for 10 years from the application date, and can be renewed indefinitely in 10-year periods.

• Standard renewal window: Starts 6 months before the expiration date
• Grace period: 6 months after expiration
• After grace period: Trademark automatically lapses and cannot be restored

• Completion of a renewal form through the BOIP platform
• Payment of the standard renewal fee
• Late renewal surcharge if renewing during the grace period
• No Power of Attorney or notarized documents required

• Restoration is not allowed after the grace period ends
• A lapsed trademark may be re-registered at any time
• The previous owner may act against infringement for up to 2 years after expiration, but must initiate proceedings within 5 years of registration expiration

• BOIP sends a renewal reminder to the owner or agent 6 months before the renewal due date
• Keep your contact information and agent details up to date

• Assuming national renewals are possible: they are not
• Missing the 6-month grace period
• Failing to act within the 2-year window after lapse
