In Uzbekistan, registration is compulsory in order to obtain rights over a trademark, as this jurisdiction follows a “first-to-file” system. This means that, as a rule, only registered trademarks are protected, and the person who files first will generally enjoy the rights. Only in exceptional cases can an unregistered but well-known trademark be protected.
Trademark applications must be filed with the Agency on Intellectual Property of the Republic of Uzbekistan IMA.
Uzbekistan is also a member state of the Madrid Protocol, which allows you to obtain protection in Uzbekistan by extending an international registration via the Madrid System.
If you register a combined trademark (including both word and figurative elements) in Uzbekistan, the exclusive right to use the mark is limited to the exact configuration in which it was filed and registered. If you would like to use the word element separately from the logo (or vice versa), it is recommended to file an additional trademark that includes only the word or only the figurative elements you wish to protect independently.
