In the Democratic Republic of the Congo (DRC), trademark registration is mandatory in order to obtain rights over a mark, as it is a “first-to-file” jurisdiction. Only in exceptional cases can an unregistered trademark be protected, so relying solely on use is not advisable.
Trademark applications must be filed with the Directorate of Industrial Property.
If you register a combined trademark (which includes both word and figurative elements), your exclusive rights are limited to the exact configuration in which the mark was filed and registered. If you wish to use the word element separately from the logo (or vice versa), it is recommended to file separate applications for the specific elements you want to protect on their own.
