Why and How to Register a Trademark in Anguilla

In order to protect a trademark in Anguilla it must be registered. Registering a trademark can be done either locally through Anguilla's Commercial Online Registration Network (ACORN), or if one has already registered the trademark in the United Kingdom, protection may be extended to this territory. The registration process in case of extension of an already registered trademark in the UK is quicker than registering an independent new trademark in Anguilla. For information visit our section on trademark registration services in the United Kingdom.

If you register a combined trademark (which includes both word elements and figurative elements) in Anguilla, the exclusive right to use the trademark is limited to a use of the trademark in the exact configuration or way in which it was filed and registered. If you wish to use the word element of your trademark separately from the logo (or vice versa), it is recommended you register for another trademark including only the word or figurative elements you wish to use and protect separately.

Nevertheless, if a third party eventually intends to register or use a trademark for similar goods or services that includes a primary or distinct part or portion of your trademark, you will have the right to oppose the application based on confusing similarity.

In order to oppose the registration of a trademark in Anguilla, oppositions will have to be presented within one (1) months from the date on which the application was published in the local gazette. Probabilities of success for an opposition will vary in each case depending on the circumstances.

The registration of a trademark in Anguilla will last for ten (10) years from the application date. It may be renewed indefinitely every ten (10) years. Trademarks may be renewed up to 1 year before their expiration dates. If a trademark in Anguilla is not renewed before its expiration date, one may still do so up to 6 months after the expiration date upon payment of a surcharge.

If the registration of the trademark in Anguilla is the extension of a UK mark, the mark’s lifespan and renewal date will be those of the UK registration.
